The crimes alleged Tuesday stem from the same 2014 sexual assault. In an earlier case brought by local prosecutors, Jones pleaded guilty to state charges, including sodomy and the distribution of material depicting sexual performance of a minor.

Not really. It's a different class of charges even though it involves the same facts. Same way Civil Rights Violations work. Honestly, I'm not a fan of the practice, but given the circumstances of this guy...

I guess I missed that paragraph.

But now that I've read it in depth, it appears the state charges were only sodomy and distribution, and the federal charge is for production, which would technically be something different.

Nah, its charges directly related from the original charges.  States it right in the article.

It's not double jeopardy if it's federal charges.

You can be charged by state and federal for same crime, or if crime took place in 2 states you can get the exact same charges in 2 states.

Man what IS it with Republicans and the pedo stuff? I can kind of understand the way they all cover for each other's financial crimes and grifting and bribery and all that. I mean it's still illegal of course and should be punished but at least I get what they're trying to do. But they seem to have a bizarrely frequent occurrence of this type of shiat. Even the ones that aren't actively participating seem to like to cover it up or handwave it away.

Guess it must be all the family values.

No and yes...governor can't pardon federal. The Feds are perfectly able to file charges if the state ones didn't stick.

Chances are Trump will pardon him just to stick it to those who opposed Bevin.

Its not double jeopardy because he was put in jail on state charges. This is a federal case.

SCOTUS ruled that this is lawful in a 7-2 ruling.

Bevin said he commuted Jones' sentence because he believed there was "zero" evidence linking him to the crime except for the "testimony of kids who were getting a better deal by throwing [him] under the bus," the Courier-Journal newspaper of Louisville reported.

"Yeah! Those kids were getting a better deal - hell, they were asking for it! Look at 'em, pleading, practically bending over backwards to score a sweet, sweet... deal. What was I saying...?"
