Vehicle theft is a much lesser charge than kidnapping and or murder. Also a missing child the police tend to give more attention.

Stop being an arse.  Kidnapping is kidnapping.  Giving it to a stranger won't get him any less of a sentence than if say he kept it until he was caught a few hours later.  It's kidnapping and child endangerment. He took it from a place of relative safety and left it in a less safe environment.

Come to think of it , if he had kept it until he was caught he could argue he didn't know the child was there and never intended to kidnap.  Dropping it off with a stranger is an intentional act.  So, I could make the reverse argument, that dropping it off with a total stranger should increase his sentence.

Look up common law definition  of kidnapping.  My argukent is thst as soon as he is dropping the kid off with a stranger he forms the intent.

The movement is the act.  He basically needed to drive back and return the child...  the intent was formed during the act of handing the child to a stranger .
