It seems to me that to deny them access to a court, with a defense representing their interests would be wrong. Perhaps there are other problems: Parents doing things that get them detained. Laws that don't take children into account.
Not the court's fault. Maybe not law enforcement's fault. Maybe not the fault of bad laws, in some cases.

It's almost like there's some due process involved before a sovereign nation does something to a child it found itself taking care of. Some of the separation stuff shouldn't be happening to begin with, so some of this is avoidable. But requiring a judges order before shipping the infant off to God knows where? What is the preferred alternative?

skylabdown: Folks trying to break into our country illegally should stop using children as pawns in their efforts...

Ellison, the head of the DNC, has come out in full-throated support of eliminating borders and removing the actual concept of what nations are.   That is what is at work when you hear "support for immigrants" from leftists.

i tried to google to find an interview he did that said he wanted to eliminate all borders.
all i found was far right wing websites that showed him wearing a t-shirt.

if you are going to judge people about clothes they wear, what did you say about "I don't care"?

Is it really surprising? 200+ years of constant support for unchecked governmental power leads to such things, as well as things like charging inanimate objects (like money) with a crime to "justify" the government's confiscation of it.

skylabdown: Folks trying to break into our country illegally Government officials who hate immigrants so much they're willing to ignore US law and international treaties concerning refugees should stop using children as pawns in their efforts...

FTFY

People coming here to escape violence that has escalated due to US policies on guns and drugs aren't the ones locking them in cages. People bringing their kids here to keep them from being raped or murdered or pressed into the service of a drug gang aren't the ones forcing them to take psychotropic drugs. The people defending the rule of law in this country aren't the ones ripping kids away from their parents.

Even if you choose to believe that you would stay in such a place and try to raise your kids there despite the violence, even if you believe you would never break a law to try to save your child from rape, murder, or kidnapping and being forced to serve a drug gang, even if you believe these people must be the scum of the earth for daring to do whatever it takes to save their kids, you still cannot possibly justify the way that this administration is treating these same kids.

What is your suggested alternative?  Deport them with no hearing on whether they qualify as refugees?

Whether they are with their parents or not, they will be called into court to face immigration charges, and in almost every case, their only available defense will be a claim for asylum.  This article is long on outrage about kids simply having immigration court proceedings and short on substance.

US law and international treaties do not say what you think they say.  Under international treaty, asylum seekers must present themselves if they want to qualify as refugees.  US law goes further and provides the opportunity to seek asylum even after being caught for illegal entry.  Neither of those rules are being violated here.

ox45tallboy: alechemist: Couldn't this lead to human rights violations from the un which could lead to sanctions?

That is not how the UN works, either.  The US left the UN Human Rights Council in the middle of a three-year stint on that body, which can issue resolutions but not sanctions -- and the US left because the UNHRC continues its predecessor's habit of being rabidly anti-Israel while mostly ignoring real human rights violations elsewhere in the world.  The US retains its status as a permanent member of the UN Security Council, along with the veto power that goes with being a permanent member.

You're so wrong here it's laughable.

First off, Keith Ellison is *not* the "head of the DNC". Nor has he ever been. He's the deputy chair. The Chairman of the DNC, the "head", is Tom Perez.

Secondly, Ellison has never said anything relating to advocacy of open borders. You can read his stance on immigration here:

https://ellison.house.gov/issues/civil-and-human-rights/immigration

Fonally, you're using the logical fallacy of a false dichotomy, in which you see the only alternative to taking kids away from their parents, locking them in cages, and forcing them to take psychotropic drugs is "eliminating borders and removing the actual concept of what nations are."

You made a silly post, and this thread is now sillier because of it. So here's a silly llama that makes about as much sense as your post did.

People who use names like "law-breaking invader" to describe asylum seekers who are actually following the law have a hidden agenda and shouldn't be trusted. Asylum seekers are welcome under US law and international treaty and should be welcomed by everyone instead of having their kids taken away and slapped with a blanket denial of asylum in violation of US law.... illegal denials of asylum without a hearing, taking of kids, locking them in cages, and forcing them to take psychotropic drugs is a scourge that must be stopped.

I definitely support Ellison's views on immigration.

And by that, I mean his actual views, and not those you attribute to him and desperately wish he held because you read it in a Facebook meme.

skylabdown: We have a refugee program.   It doesn't involve folks breaking in to the country and then when caught.... saying "I'm a refugee!"

Yes, it involves asking for asylum and being given a hearing, not having your kids taken away from you and given a blanket denial regardless of your circumstances.

skylabdown: Mexico is totally capable of handling legit refugees...  so is Costa Rica.

Indeed. And they've taken in many. We're perfectly capable of also taking in quite a few, especially considering it is our policies on drugs and guns, not Mexico's or Costa Rica's, that have resulted in the escalation of violence in these Central American countries that are causing the refugees to flee in the first place.

skylabdown: Folks are gaming the system and you have no issue because you don't believe in borders... at least be honest about it.

Folks are obeying the laws as they are written regarding asylum and still having their kids taken from them and issued blanket denials with no hearing and you have no issue because you are worried about demographic shifts in the population, at least be honest about it.
